License Details
- 1.
The Purchased License grants you, the purchaser, an ongoing, non-exclusive, worldwide license to make use of the digital work (Item) you have selected. Read the rest of this license for the details that apply to your use of the Item.
- 2.
You are licensed to use the Item to create one single End Product for yourself or for one client (a “single application”).
- 3.
An End Product is one of the following things, both requiring an application of skill and effort.
- 3.1.
For an Item that is a template, the End Product is a customized implementation of the Item.
For example: the item is a website theme and the end product is the final website customized with your content.
- 3.2.
For an Item that is an application, the End Product is a work that incorporates the Item as well as other things, so that it is larger in scope and different in nature than the Item.
For example: the item is a web application and the end product is a website along with customized or enhanced version of that application.
- 4.
You can create one End Product for a client, and you can transfer that single End Product to your client for any fee. This license is then transferred to your client.
- 5.
You can modify or manipulate the Item. You can combine the Item with other works and make a derivative work from it. The resulting works are subject to the terms of this license. You can do these things as long as the End Product you then create is one that’s permitted under clause 3.
For example: You can license a template, include your own pages and/or photos, modify the layout and get it ready for yourself or for one client.
- 6.
You can’t Sell the End Product, except to one client (you or your client can't Sell the End Product).
- 7.
You can’t re-distribute the Item, in a tool or template, or with source files. You can’t do this with an Item either on its own or bundled with other items, and even if you modify the Item. You can’t re-distribute or make available the Item as-is or with superficial modifications. These things are not allowed.
For example: You can’t purchase an HTML template, convert it to a WordPress theme and Sell or give it to more than one client. You can’t license an item and then make it available as-is on your website for your users to download.
- 8.
You can’t use the Item in any application allowing an end user to customize a digital or physical product to their specific needs, such as an “on demand”, “made to order” or “build it yourself” application. You can use the Item in this way only if you purchase a separate license for each final product incorporating the Item that is created using the application.
- 9.
Although you can modify the Item and therefore delete unwanted components before creating your single End Product, you can’t extract and use a single component of an Item on a stand-alone basis.
For example: You license a website theme containing javascript library. You can delete unwanted it from the theme. But you can't extract it to use outside of the theme.
- 10.
You must not permit an end user of the End Product to extract the Item and use it separately from the End Product.
- 11.
You can’t use an Item in trademark, or service mark.
- 12.
For some Items, a component of the Item will be sourced from elsewhere and different license terms may apply to the component, such as someone else’s license or an open source or creative commons license. If so, the component will be identified in the Item’s description page or in the Item’s downloaded files. The other license will apply to that component instead of this license. This license will apply to the rest of the Item.
For example: A theme might contain images licensed under a Creative Commons CCBY license. The CCBY license applies to those specific images. This license applies to the rest of the theme.
- 13.
For some items, a GNU General Public License (GPL) or another open source license applies. The open source license applies in the following ways:
- 13.1.
Some Items, even if entirely created by us, may be partially subject to the open source license: a ‘split license’ applies. This means that the open source license applies to an extent that’s determined by the open source license terms and the nature of the Item, and this license applies to the rest of the Item.
- 13.2.
For some Items, we may have chosen to apply a GPL license to the entire Item. This means that the relevant GPL license will apply to the entire Item instead of this license.
- 14.
You can only use the Item for lawful purposes. Also, if an Item contains an image of a person, even if the Item is model-released you can’t use it in a way that creates a fake identity, implies personal endorsement of a product by the person, or in a way that is defamatory, obscene or demeaning, or in connection with sensitive subjects.
- 15.
Items that contain digital versions of real products, trademarks or other intellectual property owned by others have not been property released. These Items are licensed on the basis of editorial use only. It is your responsibility to consider whether your use of these Items requires a clearance and if so, to obtain that clearance from the intellectual property rights owner.
- 16.
This license can be terminated if you breach it. If that happens, you must stop making copies of or distributing the End Product until you remove the Item from it.
- 17.
Tecdiary retains ownership of the Item but grants you the license on these terms. This license is between Tecdiary and you.

License Comparison
The majority of our items (applications, themes, code scripts and graphics) are covered by our Regular/Standard Licenses. If your end product including the item is going to be free to the single end user then a Regular License is what you need. An Extended License is required if the end user must pay to use the end product.
Regular | SaaS | Extended | |
---|---|---|---|
Number of end products | 1 | 1 | 1 |
Use in a single end product | Yes | Yes | Yes |
Use in an end product that's sold | No | No | Yes |
Source Code | Yes | Yes | Yes |
On-demand products/services (e.g. "made to order" or "create your own" apps and sites) | 1 license/install | 1 license/install | No |
Use in other items | No | No | Yes |
* Note to freelancers and creative agencies:
You may charge your client for your services to create an end product, even under the Regular/Standard License. But you can’t use one License for multiple clients or jobs. You need to purchase a separate license for each end product you create for each client.
License FAQs
What are the main differences between Regular and Extended License?
The Regular License can't be sold. While the Extended License can be modified and sold as single End Product.
Can I use Regular/Standard License for Software as a Service?
No. You can't use regular license for Software as a Service type/model of End Product. You should purchase the SaaS (if available) or Extended License.
I am planning to use the item in a product that I will Sell. Which license do I need?
You can purchase Extended License for single End Product that can be sold or installed unlimited times. With extended license, you can integrate the item in any End Product that you plan to sell.
Which license do I need for an end product that is freely accessible or freely distributed to users?
No. we don't offer such license at this moment.
I am a commercial entity or run a business. Do I always need an Extended License?
No, just using the item in a commercial setting doesn't necessarily mean you need an Extended License. You need an Extended License if the end product is sold to end users. If the end product is not, even if you are a commercial enterprise, you only need a Regular/Standard License.
Can I re-distribute an item? What about under an Extended License?
No. You can't license items and then make them available to others 'as-is' (that is, as a stand-alone item), regardless of which license you purchase.
If I purchase an Extended License, do I get a multi-use, multi-domain, multi-client or developer license?
No. The Extended License is still limited to a single end product that can be installed unlimited times. Some item comes with Software as a Service (SaaS) license that allows you to install on single domain and charge subscription fee to your end users.
